1. Acceptance of Terms

By accessing or using the Pathanshala website, mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please do not use the Platform. Pathanshala is owned and operated by Star Web India ("we", "us", "our").

2. Description of Service

Pathanshala is a marketplace that connects students and other seat-seekers ("Users") with independently owned libraries, reading rooms and study spaces ("Partners") for the purpose of discovering and booking study seats on an hourly, daily or monthly basis. Pathanshala acts as an intermediary platform and is not itself the operator of any library or reading room listed on the Platform.

3. Eligibility & Account Registration

• You must be at least 16 years of age, or accessing the Platform under the supervision of a parent or guardian, to create an account.
• You agree to provide accurate, current and complete information during registration and to keep your account information updated.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4. Bookings, Payments & Cancellations

• Seat availability shown on the Platform is updated by Partners in real time but is not guaranteed until a booking is confirmed and paid for.
• All payments are processed through secure third-party payment gateways. Pathanshala does not store your full card or banking details.
• Cancellation and refund eligibility depends on the specific Partner's cancellation policy, shown at the time of booking, and the time remaining before the booked slot begins.
• Repeated no-shows or cancellations may result in restrictions on your ability to make future bookings.

5. For Library & Reading Room Partners

• Partners must provide accurate information about seating capacity, amenities, pricing and operating hours, and keep this information current.
• Listings are subject to verification by Pathanshala before and after going live, and may be suspended if information is found to be misleading.
• Pathanshala charges Partners a commission only on confirmed bookings received through the Platform, as disclosed during onboarding.
• Payouts are settled to the Partner's registered bank account on the schedule communicated at the time of registration.

6. User Conduct

You agree not to misuse the Platform, including but not limited to: submitting false booking or listing information, attempting to circumvent payments made through the Platform for bookings initiated on it, harassing other Users or Partners, or using the Platform for any unlawful purpose.

7. Intellectual Property

All content on the Platform, including the Pathanshala name, logo, design, text and software, is the property of Star Web India or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce or distribute any part of the Platform without prior written permission.

8. Third-Party Links & Services

The Platform may contain links to or integrations with third-party services, including payment gateways and messaging services such as WhatsApp. Pathanshala is not responsible for the content, policies or practices of any third-party service.

9. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. While we take reasonable steps to verify listings, Pathanshala does not guarantee the accuracy of every detail provided by Partners and makes no warranty regarding uninterrupted or error-free operation of the Platform.

10. Limitation of Liability

To the maximum extent permitted by law, Pathanshala and Star Web India shall not be liable for any indirect, incidental or consequential damages arising from your use of the Platform, including disputes between Users and Partners, except to the extent such liability cannot be excluded under applicable Indian law.

11. Indemnification

You agree to indemnify and hold harmless Pathanshala, Star Web India and their respective officers and employees from any claims, damages or expenses arising out of your violation of these Terms or misuse of the Platform.

12. Termination

We reserve the right to suspend or terminate your access to the Platform, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to other Users, Partners or the Platform.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Indore, Madhya Pradesh, India.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services or legal requirements. The updated version will be posted on this page with a revised "Last updated" date, and continued use of the Platform after such changes constitutes acceptance of the revised Terms.
